1. Scope

1.1 These General Terms and Conditions (GTC) apply to all language courses and other services offered by LangIsland School GbR.

1.2 Any conflicting or deviating terms and conditions of participants shall not apply unless LangIsland School has expressly agreed to their validity in writing.

2. Registration and conclusion of contract

 

2.1 Registration for our courses takes place online via our website, by email, or in person at our language school. By submitting the registration, the participant makes a binding offer to enter into a contract.

2.2 The contract is concluded as soon as we confirm participation by sending a registration confirmation or by issuing an invoice.

2.3 The booking is made via a button labeled “Book now”.

2.4 Before submitting the registration, the entered data can be checked and corrected at any time.

2.5. Upon receiving the visa, each participant is obligated to complete the booked courses within the timeframe specified in the registration confirmation. Courses may no longer be rescheduled.

2.6. Please note that you can only participate in our language courses if you are at least 18 years old.

 

3. Right of withdrawal

3.1 Exclusion of the right of withdrawal for courses with a fixed date

The intensive courses, evening courses and all other language courses with a fixed start date and fixed period offered by LangIsland School are services related to leisure or educational activities.

These courses are available no right of withdrawal pursuant to Section 312g para. Section 2 No. 9 of the German Civil Code (BGB).

The participant is explicitly informed of the exclusion of the right of withdrawal before completing the booking (registration form, checkbox, booking confirmation).

3.2 Services without a fixed appointment

For services without a fixed date or period (e.g., individual lessons, consulting services), the statutory right of withdrawal applies. The corresponding cancellation policy will be provided separately in these cases.

4. Course fees and payment terms

4.1 The prices in euros, including statutory VAT, published on our website at the time of registration apply.

4.2 In addition, a one-time registration fee of EUR 29 will be charged. This fee is non-refundable.

4.3 The course fee is payable in full within 7 days of invoicing, unless payment in installments has been agreed.

4.4 Payment in installments is possible by arrangement. If the participant(s) In case of late payment, we reserve the right to exclude the participant(s ). to be excluded from the course. The payment claim remains valid.

4.5 Any bank or transaction fees shall be borne by the participant , to the extent permitted by law.

5. Course organization

5.1 A lesson lasts 45 minutes.

5.2 Allocation to morning or afternoon courses is solely based on organizational requirements. There is no entitlement to specific lesson times.

5.3 A change of teachers does not entitle the participant to a reduction or refund of the course fee.

6. Participation requirements

6.1 Participation in our courses is reserved exclusively for adults.

6.2 For higher course levels (A2–C1), proof of language proficiency or a passed placement test is required.

7. Visa refusal / cancellation due to visa reasons

7.1 If the participant is refused entry into the Federal Republic of Germany due to a negative visa decision by the competent German diplomatic mission abroad, the contract may be terminated. irrespective of the exclusion of the right of withdrawal pursuant to Section 312g para. Section 2 No. 9 of the German Civil Code (BGB) be cancelled.

7.2 The prerequisite for this is that the participant submits a copy (PDF) of the official rejection notice from the German diplomatic mission to the LangIsland School via email within 14 days of receiving it .

7.3 In this case, we will refund the course fee paid, less an administrative fee. in the amount of €100. The registration fee is non-refundable.

7.4 The contractually agreed right to cancellation in the event of a visa refusal remains unaffected by the exclusion of the right of withdrawal .

7.5 Course changes are only possible after prior written agreement and subject to availability. There is no right to a postponement.

8. Intensive courses

8.1. To participate in our intensive A1 level courses, you must know the Latin alphabet; no other requirements apply.

8.2. To participate in intensive courses at the higher levels (A2 to C1), we require current proof of your language proficiency (no more than two years old). We only accept certificates from German-speaking countries (Germany, Austria, and Switzerland) or those issued by a Goethe-Institut.

8.3. If you do not possess one of the aforementioned language certificates, you must first successfully complete an entrance or placement test with us. The entrance test is online and free of charge.

8.4. Our intensive courses at level A1 last approximately 7-8 weeks and comprise around 140 teaching hours . Our intensive courses at level A2 last approximately 7-8 weeks and comprise around 160 teaching hours. Our intensive courses at levels B1, B2, and C1 last approximately 7-8 weeks and comprise around 200 teaching hours . If the minimum number of 18 participants is not reached, the number of teaching hours may be reduced. In addition to traditional classroom instruction, the teaching hours for each course level may include workshops, project work, written assignments, tests, and the necessary preparation and follow-up work.

9. German for Medical Students

9.1 The “German for Medical Professionals” courses are language courses with a fixed date and fixed period .

9.2 These courses no right of withdrawal pursuant to Section 312g para. Section 2 No. 9 of the German Civil Code (BGB).

9.3 The participation requirements, course content and organizational framework conditions are set out in the respective course description.

10. Individual lessons

10.1 Individual lessons are services without a fixed date or period , unless otherwise expressly agreed.

10.2 For individual lessons, the statutory right of withdrawal applies in accordance with § 355 BGB .

10.3 Cancellation policy (individual lessons)

Consumers have a statutory right of withdrawal when concluding a distance selling contract or a contract concluded off-premises.

You have the right to withdraw from this contract within fourteen days without giving any reason .

The cancellation period is fourteen days from the day the contract is concluded .

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by email or post).

To meet the cancellation deadline, it is sufficient that you send the notification of exercising your right of cancellation before the cancellation period expires .

Consequences of the revocation

If you cancel this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we received your cancellation notice.

For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise.

11. Internal audits and certificates

11.1. The final exam usually takes place on the penultimate day of class. Successful completion of the final exam is a prerequisite for successfully completing the course.

11.2 Participation in the final examination requires regular attendance at the course (at least 75%).

11.3 Examination content, passing grades and retake opportunities are governed by the applicable course and examination conditions.

11.4. The exam is failed if you do not meet the aforementioned requirements. In this case, you may retake the exam once. A further fee of €149 must be paid for the retake.

11.5. If you fail the retake attempt, you have the option to repeat the language course if there is available capacity.

11.6. If you booked an intensive course at the next higher language level before receiving your retake exam results, but failed the retake, we may, in individual cases and after careful review, still admit you to the course at the next higher language level. Otherwise, you agree to repeat the failed course if space is available.

11.7. If cheating is attempted, the exam is considered failed and a retake is not possible.

11.8. These rules apply to both our in-person and online courses.

11.9. If you are unable to attend the final examination on the date we have set for you due to important reasons, we will arrange an individual date for the final examination with you. We charge an additional fee of EUR 149.00 for this.

11.10. By participating in the online final exam, each course participant agrees to treat the exam content of the LangIsland School confidentially and not to reproduce or pass it on to third parties.

11.11. Each course participant is responsible for ensuring they have a stable internet connection, sound, and other necessary technical requirements to complete the final exam. In the event of any disruptions to the stability of the internet connection during the final exam that are not caused by LangIsland School, the participant is fully liable. This may lead to exclusion from or termination of the final exam, potentially resulting in a failing grade or a failed attempt. The assessment of the situation is at the discretion of the examiner and will be considered on a case-by-case basis. A retake of the final exam is possible after exclusion from or failure due to internet problems. A fee of €149.00 will be charged for this.

11.12. Each course participant is obligated to follow the instructions of the responsible examiner. Furthermore, the examinee agrees to disclose their workspace upon request of the instructor, to surrender their technical equipment before the start of the examination, or to share their screen during online examinations. Refusal to do so constitutes grounds for immediate exclusion and will result in failing the examination.

12. Internal language tests for external participants

12.1. Our institution offers language tests at levels A1-C1 according to the CEFR regulations for external participants, which can be taken both online and on-site.

12.2. The examination fees for the respective course levels are set as follows and must be paid in full before the start of the examination, but no later than the day of the examination: Course level A1 – C1: 199.00 EUR.

12.3. Exam registration takes place on site or online by filling out a corresponding exam form, which will be provided to the examinee in advance by the LangIsland School team within a reasonable time.

12.4. The exam result and the certificate will be announced or issued within 48 hours.

13. telc exams

13.1 The LangIsland School is a certified telc examination center and offers telc examinations for internal and external participants .

13.2 In addition to these General Terms and Conditions, the currently valid General Terms and Conditions, Implementation Provisions and Examination Regulations of telc gGmbH apply to registration and participation in telc examinations .

13.3 By registering for a telc exam , the participant acknowledges both these General Terms and Conditions of LangIsland School and the telc Examination Regulations and the telc General Terms and Conditions as binding.

13.4 In case of discrepancies between these General Terms and Conditions and the regulations of telc gGmbH, the regulations of telc gGmbH shall prevail insofar as they concern the conduct, evaluation, repetition or exclusion of examinations.

13.5 The organizational regulations of the LangIsland School (e.g. house rules, security and identity checks, deadlines, rules of conduct at the examination site) remain unaffected and must be complied with by the participants .

14. Hybrid courses (online & in-person)

14.1 All intensive courses will be held as hybrid events The course is conducted. The lessons take place simultaneously online and in person at our classrooms in Bochum. The participant(s) Participants can decide for themselves whether to participate online or in person.

14.2 Online participation in hybrid courses takes place via the Zoom platform.. The necessary technical requirements (in particular a stable internet connection, suitable hardware and software installation) must be met by the participant.:to ensure oneself.

14.3 Making any kind of recording (especially video, audio or screen recordings) of lessons or examinations is prohibited.

15. Liability

15.1 We are liable without limitation in cases of intent, gross negligence, and injury to life, body, or health.

15.2 In cases of slight negligence, we are only liable for breaches of essential contractual obligations and only to the extent of foreseeable damage.

15.3. To participate in our online courses, participants need sufficient internet access, a standard web browser, a fully functional camera (e.g., a webcam), and a fully functional microphone and headphones (e.g., a headset). Before the start of the online course, participants must also download, install, and, if necessary, register the “Zoom Meetings” software. The software can be downloaded from zoom.us. We do not cover any costs associated with downloading or registering the software. Participants are responsible for ensuring they meet these requirements; we are not obligated to assist participants in setting up the necessary technical equipment. We also do not guarantee that participants’ internet connections will be uninterrupted or free of disruptions during the duration of our online courses.

16. Obligations of our course participants

16.1. Our course participants must ensure that their stay in Germany complies with the applicable residence regulations.

16.2. Our course participants are obligated to comply with the school rules. These rules will be distributed and discussed with participants during the first lesson; they are also posted at the school and can be viewed there. In the event of repeated violations of these rules, we reserve the right to exclude the participant from the course. In this case, our claim to payment of the course fee remains valid, and the participant is not entitled to a refund of the course fee already paid.

16.3. Our course participants are responsible for ensuring they have adequate insurance coverage in Germany, particularly health and liability insurance. We assume no responsibility in this area.

16.4. Our course participants are not permitted to film, photograph, or make any other recordings, such as audio recordings, during our course sessions. The teaching staff and other course participants may, of course, not be filmed, photographed, or otherwise recorded.

17. Data protection

The data protection regulations apply in accordance with our privacy policy at www.langisland-school.de/datenschutz .

The teaching materials are protected by copyright. Distribution to third parties or reproduction is not permitted unless the copyright holder has given prior consent.

18. Final Provisions

18.1. There are no oral side agreements to this contract. Deviations and additions are only valid if they are agreed upon in writing. This also applies to this written form clause.

18.2. The place of performance and exclusive venue for all claims arising from or in connection with this contract is Bochum, provided that the contracting parties are merchants, legal entities under public law, or special funds under public law, or if they have no general place of jurisdiction in the Federal Republic of Germany, or if they move their domicile or habitual residence outside the scope of the German Code of Civil Procedure after conclusion of the contract, or if their domicile is unknown at the time the action is brought. These provisions also apply to actions based on documentary evidence and bills of exchange.
